This nomination, then, is good news on several fronts. If confirmed, Judge Alito will help steer the Supreme Court back toward restraint and interpretation, rather than improvisation, of the law. And, even as many quarters on the left have derided such a long and clear record as "conservative judicial activism" and vowed a fight, Mr. Bush has nominated Judge Alito anyway. Perhaps this marks a return to the courage Americans voted for when they returned President Bush to office.

Unlike other big exchanges, however, the TSE appears to have skimped on testing and crisis management a common theme across Japanese financial services companies. The back-up system, which should have kicked in when the trading system crashed, uses the same software. So do some of Japan's other stock exchanges. Similarly, the back-up system designed to withstand earthquakes simply duplicates the main system and is housed in the same (admittedly, robust) location.

Contemporary Europeans downplay national identity in favor of an open, tolerant, "post- national" Europeanness. But the Dutch, Germans, French and others all retain a strong sense of their national identity, and, to differing degrees, it is one that is not accessible to people coming from Turkey, Morocco or Pakistan. Integration is further inhibited by the fact that rigid European labor laws have made low-skill jobs hard to find for recent immigrants or their children. A significant proportion of immigrants are on welfare, meaning that they do not have the dignity of contributing through their labor to the surrounding society. They and their children understand themselves as outsiders.
Two things need to happen: First, countries like Holland and Britain need to reverse the counterproductive multiculturalist policies that sheltered radicalism, and crack down on extremists. But second, they also need to reformulate their definitions of national identity to be more accepting of people from non-Western backgrounds.

BEIJING, Nov. 3 -- China plans to abolish legal distinctions between urban residents and peasants in 11 provinces as the government tries to slow the country's surging wealth gap and reduce social unrest, media reports said Wednesday.
Under an experimental program, local governments in those provinces will allow peasants to register as urban residents and to have the same rights to housing, education, medical care and social security that city dwellers have.
If carried out as advertised, the program would eliminate a cornerstone of the population control policies begun by Mao in the 1950's. The system of residence permits, known as hukou, ties every person to a locale and once made travel difficult without permission.
In practice, the system has been fading away for more than a decade. An estimated 200 million peasants have left the countryside to live in urban areas, some of them full time. Their access to urban services varies widely depending on local rules and the kind of employment they find.
In today's market-oriented economy, the once-comprehensive socialist benefits bestowed on urban residents carry far less weight. Most people rely on their own resources, or those of their employers, to pay for health care, housing and schooling.
The central government declared that it intended to drop the residency permit system at the 16th Communist Party Congress in 2002, and has made incremental changes since.
Doing away with the residency system also fits the political agenda of President Hu Jintao and Prime Minister Wen Jiabao, who have tried to demonstrate that they are more attentive to people left behind in China's economic boom.
The 11 major provinces involved in the latest move include Guangdong, Fujian and Liaoning. China has 23 provinces. Articles about the change in several state-run publications suggested, though, that the Public Security Bureau, remained deeply wary of the change and may slow its progression.

Pearson named Lionel Barber, currently the FT's U.S. managing editor, as the FT's new editor. He will start immediately, returning to London full-time from January 2006, the company said. Mr. Barber, 50, joined the FT 20 years ago, having begun his career at the Scotsman and the Sunday Times. "Machine gun" is a term most people use instead (even the media), even though that is wildly inaccurate. "AK-47" is not that uncommon, though.
I'm not sure what the French police use. The best I could find is they have used the Mat 49.
Which other than not having a banana clip, but straight, could pass off as a AK-47 I dunno if they have a newer SMG or not. Their newest rifle is bullpup, which generally means there isn't a smg form of it.
The Opinion Journal piece illustrates [in my opinion] a theory in transition, a point of view being held together by a patch. Is it possible to "reverse the counterproductive multiculturalist policies that sheltered radicalism, and crack down on extremists" and then "reformulate their definitions of national identity to be more accepting of people from non -Western backgrounds"? Or isn't that rather like taking two aspirins prior to massaging your head with a claw hammer? Nevertheless, Mr. Fukuyama's article is a welcome sign that the "police action" policy towards radical Islamic terrorism is following the "earth is flat" theory into its final intellectual moments.
What events in France have done is discredit the liberal recipe so badly that even those who are not prepared to admit that American policy may have been right must now root around for an alternative theory. Fukuyama's essay is a good step in that direction. Faster please.

In the wake of violent incidents committed by some of their own citizens, and of criticism that they had been too lax in integrating their own societies, some of France's European partners, especially the British and Dutch, had begun to see merit in France's more proactive integration tradition. But the past week of nightly clashes in the Paris suburbs of police with ethnic minority youths will have popped any illusion that France is any nearer the right model than they are.
There is one other lesson that France could learn, this time from the UK. This is the use of the labour market to integrate people into society. Britain has recently taken further steps to allow immigrants' working-age dependents to work. Providing more jobs in its neglected suburbs would be the best way for France to make its minorities feel valued by the majority.

The ghetto is quite common the world over, but much less so in America.

The growing frequency of attacks like this, in contrast to the car and trash hopper blazes set by marauding youths earlier in the unrest, prompted Paris prosecutor Yves Bot to join the officials blaming the rioting on organized gangs.

It consisted in a frank realization that two civilizations were clashing, where only one could prevail. The choice was relatively simple: victory over the invaders, or death and servitude.

Accused of stoking passions by calling troublemakers "scum", Sarkozy has ignored calls to quit. A survey published on Sunday indicated his public image was holding up, even if many disapproved of his strong language.
For half a decade, French Arabs have been carrying on a low-level intifada against synagogues, kosher butchers, Jewish schools, etc. The concern of the political class has been to prevent the spread of these attacks to targets of more, ah, general interest. They seem to have lost that battle. Unlike America's Europhiles, France's Arab street correctly identified Chirac's opposition to the Iraq war for what it was: a sign of weakness.
If Chirac isn't exactly Charles Martel, the rioters aren't doing a bad impression of the Muslim armies of 13 centuries ago: They're seizing their opportunities, testing their foe, probing his weak spots. If burning the 'burbs gets you more ''respect'' from Chirac, they'll burn 'em again, and again. In the current issue of City Journal, Theodore Dalrymple concludes a piece on British suicide bombers with this grim summation of the new Europe: ''The sweet dream of universal cultural compatibility has been replaced by the nightmare of permanent conflict.'' Which sounds an awful lot like a new Dark Ages.
Police also found a gasoline bomb-making factory in a rundown building in Evry, a southern Paris suburb that contained 150 explosives, more than 100 bottles, gallons of fuel and hoods for hiding rioters' faces, Jean-Marie Huet, a senior Justice Ministry official, said Sunday.
Ali Kerimli, one of the three main opposition leaders, said his Popular Front of Azerbaijan had already recorded "numerous violations" in voting. If fraud proved to be "massive," the opposition would consider calling for the results to be annulled, he said.
Panakh Guseinov, campaign chief for the opposition bloc, said it had recorded "5,947 incidents of violations."

In spite of the growing unrest, Mr Sarkozy's popularity has survived relatively unscathed. According to an opinion poll published this weekend for Le Parisien newspaper, 57 per cent of people had a positive image of Mr Sarkozy.
