The anti terrorism bill was adopted on Tuesday at meeting of the Lower House Committee. A bill allowing the Self-Defense Forces (SDF) to provide non-combat support to the U.S.-led war against terrorism cleared a House of Representatives' plenary session on Thursday and seems set to become law. As the proposed legislation stands, the SDF can be sent off without the Diet's approval -- sanction from the national legislature is only required within 20 days after the troops are dispatched. That is a problem.
The Diet, responsible for exercising civilian control over SDF operations, should have insisted that any deployment supporting military operations in Afghanistan be made only after obtaining its prior approval.
We have supported the government's decision to cooperate with the international community in the fight against terrorism. Since SDF operations could unfold unpredictably and lead to a dramatic shift in postwar national security policies, however, the Diet must become involved to ensure that the people's will is reflected.
The government's decision to tag on a two-year time limit to the bill is commendable because the Diet will have another opportunity to deliberate before any extension of the legislation is considered. However, the proposed legislation is still controversial -- and even unconstitutional, some critics maintain.
Initially, the government had argued for a bill requiring it to submit a report on SDF operations to the Diet. If prior approval were necessary, they claimed, the ability of the government to
respond to an emergency would be slowed down.
The government is currently permitted to mobilize the SDF for domestic emergencies without Diet approval. And one cannot deny that the U.S. has asserted its leadership in conducting the bombing campaign against Afghanistan and in negotiating behind the scenes to shape the post-Taliban administration.

Separation of powers In a democracy, the separation of powers doctrine is commonly understood to entail the division of government into three branches -- the legislature, the executive, and the judiciary. In Japan, most citizens are first exposed to this doctrine in the sixth grade, and study it in more detail in the third year of junior high school. The doctrine can be traced back to the "Spirit of the Laws" by the French political philosopher, Montesquieu, and to the ideas of John Locke.
