集団的自衛権の行使を憲法解釈の変更で容認しようという動きに反対する人た
ちが１４日、広島市の原爆ドーム前で集会を開きました。

集会は、憲法を守る立場の団体や労働組合に所属する人たちおよそ３０人が広
島市中区の原爆ドーム前で開きました。

集まった人たちは、「有識者の懇談会という私的な学習会が提出した報告書を
基に、一方的に憲法解釈を変えるとすれば異常な事態だ」という意見や、「子
どもや孫が戦場に行かなくてもよい環境を作ろう」などと次々に反対意見を訴
えました。

集会に参加した「広島県９条の会ネットワーク」事務局長の石口俊一弁護士は、
「憲法９条の本質的な部分を解釈で変えてもよいというお墨付きを与えること
の問題がある。また、場合によっては、自衛隊が殺し、殺されることを正当化
することは広島の考えと反している」と話していました。

集会を開いた団体などは、報告書が提出される１５日も広島市中心部で反対を
訴える集まりを開くことにしています。

原爆の威力で押し付けられた憲法ｗ

日本国憲法は、第9条第2項において、戦力の保持を禁じている。
これに対し、自民党の日本国憲法改正草案（以下、単に「自民党案」という。）においては、同項の戦力不保持の規定を削除し、第9条の2を新たに新設し、国防軍を保持するのだという。
ここで問題となるのが、この改正草案においては、徴兵制を禁ずる旨の規定が置かれていないということである。
すなわち、現行の規定では、戦力の保持を禁止されているところ、改正草案によると、国防軍を保持するというのであるから、
この改正によって、立法によって徴兵制を導入し得るとの解釈があり得るのである。
この点、徴兵が憲法第18条の「苦役」にあたると解する立場によれば、改正後に新設される同条第2項によって徴兵制は禁止されるという結論になるが、
徴兵が苦役にあたらないという立場に立てば、立法によって徴兵制が導入し得るという結論に至るのである。
解釈の仕方によっては、徴兵制を導入し得る条文となるのであるから、やはり明示的に徴兵制を禁止する旨の規定をおくべきであろう。
もう１つの問題が、核兵器の保有の問題である。
現行の憲法第9条第2項は、戦力の保持を禁止しており、核兵器はここにいう戦力にあたるのは明らかであるから、核兵器を保有することができないのは当然である。
これに対し、前記のとおり、自民党案においては、同項の戦力不保持の規定を削除しているところから、憲法上は核兵器を保有することが可能となる。
したがって、これについても、明示的に核兵器の保有を禁止する旨の規定をおくべきであろう。

もし仮に、自民党が徴兵制や核兵器保有の余地を残しておくべきと考えているのであれば、そのようなことが将来的にあり得る旨を国民に明らかにし、その信を問うべきであろう。

なんで原爆ドームなんだろ？
やるなら東京ドームとかでやれよ

中国に9条進めてこいよ。

NATO条約第５条に、NATO加盟国が攻撃を受けた場合には、
自国への攻撃ととらえ、集団的自衛権を行使するとある。

２００１年に、NATO条約は、領域を拡大、全世界の事態に即時対応できるよう変更した。

欧州諸国にとっても、相手が中国ならば現実的脅威。
中国が強大過ぎるので、米国なら近過ぎで手出しするのを嫌がるかもしれないが
欧州諸国なら中国に敵対するには適している。

The New NATO Force Structure

NATO military authorities agreed in July 2001 on the principles and
parameters of the ‘new’ NATO Force Structure (NFS)

Under the new concept, NATO forces should be able to rapidly deploy to
crisis areas and remain sustainable, be it within or outside NATO’s territory,
in support of both Article 5 and Non-Article 5 operations.



Article 5 is at the basis of a fundamental principle of
the North Atlantic Treaty Organisation. It provides that if
a NATO Ally is the victim of an armed attack, each and every other
member of the Alliance will consider this act of violence as
an armed attack against all members and will take the actions
it deems necessary to assist the Ally attacked.

This is the principle of collective defense.

The principle of collective defense is at the very heart of NATO’s founding
treaty. It remains a unique and enduring principle that binds its members
together, committing them to protect each other and setting a spirit of
solidarity within the Alliance.

This principle is enshrined in Article 5 of the North Atlantic Treaty.
It provides that if a NATO Ally is the victim of an armed attack,
each and every other member of the Alliance will consider this act of
violence as an armed attack against all members and will take the actions
it deems necessary to assist the Ally attacked.

Mr. Abe’s highest political goal is to replace the Constitution written
and imposed upon the Japanese by the American Army following World War II.
For 67 years, not a single word has been amended. Mr. Abe strongly feels
that the Constitution imposes an onerous restriction on Japanese sovereignty
and is outdated. Still, as critics point out, he should know that
the Constitution’s primary function is to check government power.
It is not something that can be altered by the whim of government.
Otherwise, there is no reason to bother with having a constitution at all.

but instead to revisit the interpretation of certain clauses of the
Constitution in light of significantly changed circumstances
