It expressed disappointment over the sentence

NEW DELHI: India has reiterated the need for humane treatment to the two Indians jailed in South
Korea for their alleged role in an oil spill and expressed its disappointment over the harsh
sentences imposed on them. It hoped that the court would take into account the complete
circumstances of the case and also consider the impact of the judgement on the maritime community
while hearing the appeals planned to be filed by the lawyers of both Indians.

These sentiments were expressed by senior Ministry of External Affairs (MEA) official N. Ravi when
he met the South Korean Ambassador here on Monday.

Captain J. S. Chawla and Chief Officer Chetan Syam were given prison sentences in connection with
an accident involving the ship ‘Hebei Spirit’ off the Korean coast last year. They had maintained
that their crude carrier was safely anchored when a crane barge being towed by another ship broke
free in the rough waters and rammed their ship, leading to one of the worst oil spills off South
Korea’s coast.

Mr. Ravi expressed the government’s disappointment with the decision of the court to reverse the
earlier judgment in which the two merchant marine officers were exonerated, as well as the
government’s “distress” at the harsh sentences. He also conveyed to the South Korean Ambassador
India’s expectations of humane treatment to Capt. Chawla and Chief Officer Syam in keeping with
their professional status.

The Ambassador assured the MEA that India’s concerns would be communicated to Seoul.

The government had taken up the matter at all levels in the Korean government in the past few
months.

The MEA raised the issue at a consultation on November 25, with the Ambassador on December 4 and
again with the Korean Foreign Ministry through the Indian Ambassador in Seoul on December 5.

India’s High Commissioner in London, who also represents the country at the International Maritime
Organisation, also raised this matter in that forum.

India understands that the lawyers of the two plan to appeal against the judgement and has conveyed
to Seoul its hope that the officers will be given bail pending the hearing of the appeal.
