日本人の孫と偽装して不法入国した大阪市の中国人男性（４３）と妻子の計５人が
「妻の父は日本人で妻子には日本国籍がある」として、大阪入国管理局に強制退去処分の
取り消しを求めた訴訟の判決で、大阪地裁は１８日、請求を認め、処分を取り消した。
　判決理由で西川知一郎裁判長は「妻の父は中国人の父と日本人の母の間に生まれ、
死亡時まで日本国籍を持っていた。子孫の妻子らには日本国籍があり、処分は違法で
無効だ」と指摘。
　夫の処分についても「不法入国は悪質だが、入管は妻子に日本国籍があることを
考慮しておらず、著しく妥当性を欠く」として違法性を認めた。
