Youths guilty of cutting head off corpse

TWO teenagers have become the first people in Scotland to be convicted of disturbing the dead in a graveyard for more than a century.
The pair were found guilty of cutting off a corpse’s head and playing with it in Edinburgh’s Greyfriars Kirkyard last year.
They had forced open the Mackenzie Mausoleum in the famous cemetery, where Sir George "Bloody" Mackenzie, a former Dean of the Faculty of Advocates under the reign of Charles II, was laid to rest in 1691.
The identity of the corpse was not known, but it was in a mummified state and was thought to have been there for many years.
A jury at the High Court in Edinburgh yesterday took two and a half hours to find
Sonny Devlin, 17, from the city, and a 15-year-old boy who cannot be named for legal reasons, guilty of "violation of a sepulchre", which carries a maximum penalty of life imprisonment.
Unemployed Devlin, of East Claremont Street, and his co- accused were the first people since 1899 to be found guilty of the crime.
They were acquitted of allegations that they forced open the coffin and simulated a sex act with the severed head.
Sentence was deferred on both until April 20 for background reports and they were allowed out on bail after their appearance before a packed courtroom.
The charge brought against them previously featured in trials against 19th-century grave robbers who were seeking corpses for anatomy lessons.
Lord Wheatley told the court: "What lies behind this offence, and always has done, is the notion that in any civilised society there should be respect for the dead.
"The essence is the dead should be treated with a proper degree of reverence."

He threw it about and chased others with it, but the drunken teenager was later caught by police after returning to the kirkyard to show off in front of a girl who did not believe his claims that he broke into a tomb and took the head.
The pair were seen running from the tomb - also known as the Black Mausoleum - on the evening of June 30 last year.
Advocate depute Alan Mackay told the jurors that it was "an appalling crime".
"Above all else, you might think a body was entitled to reverential treatment when in a coffin or tomb. This body was in a coffin.
"No matter how old it was, it was entitled to be treated with reverence," he said.
Mr Mackay added: "The head had muscle, skin and teeth, and indeed an earring in the ear, and was recognisable as human."
Lord Wheatley thanked the jurors after they returned majority guilty verdicts against the pair. He told the ten men and five women:
"You can get any kind of case thrown at you - a murder case, a drugs one. You got one not heard in these courts for over 100 years."
The last recorded "grave robbing" case in a Scottish High Court was in 1899 when William Coutts faced six charges of violation of a sepulchre - a term which comes from the Latin for "burial place".
As the superintendent of Nellfield Cemetery, a graveyard on Great Western Road in Aberdeen, he was jailed for six months for digging up coffins and reselling the lairs for other burials.
Professor Christopher Gane, a leading expert on Scots law at Aberdeen University, said: "It is an offence without proper authority to interfere with the remains of a person who is dead when they have been put in a tomb.
